Terms of Service

Welcome to Trial by Chat ("the Service," "we," "us," or "our"), operated by MadRabbitGod LLC. By accessing or using Trial by Chat, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility and Age Requirement

Trial by Chat contains mature, crude, and sexually suggestive humor intended for adult audiences. You must be at least 18 years old to use this Service. By using Trial by Chat, you represent and warrant that you are 18 or older.

Hosts are additionally responsible for ensuring their use of the Service complies with the terms of service of any platform they stream on (e.g., Twitch), including any age-rating or content-labeling requirements for mature content.

2. Account Access

• Hosts must log in using Twitch OAuth to create and run a game lobby. This grants the Service limited access to your Twitch account identity and, where applicable, permission to read chat messages in your channel for the purpose of tallying votes and nominations.
• Players may join a game using a display name and join code with no account required.
• You are responsible for maintaining the security of your Twitch account and for all activity that occurs through your session.

3. Subscriptions and Payment

• Certain features (currently: the chat-nomination system) require an active paid subscription, billed monthly through our payment processor, Stripe.
• We do not store your full payment card details — all payment processing is handled directly by Stripe in accordance with its own terms and privacy practices.
• Subscriptions renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for the remainder of a billing period unless required by law.
• We may offer promotional or discount codes at our sole discretion, including free or reduced-cost trial access for select users.
• Prices and included features may change with notice posted on the Service or communicated to subscribers.

4. User-Generated Content

• Card submissions and chat nominations: Players may submit response cards during gameplay, and viewers may nominate chat messages for potential inclusion as cards via the nomination feature (where enabled). Hosts review and approve nominations before they become active in their games.
• By submitting or nominating content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and use that content within the Service (including in gameplay and on stream overlays).
• You are responsible for content you submit or nominate. We reserve the right, but not the obligation, to review, moderate, reject, or remove any user-submitted content at our discretion.
• Do not submit content that is illegal, infringes on others' rights, contains real private information about identifiable individuals without consent, or violates applicable platform terms (e.g., Twitch's Community Guidelines).

5. Acceptable Use

You agree not to:

• Attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure
• Use automated tools to abuse voting, nomination, or lobby-creation systems beyond intended use
• Harass, threaten, or target real individuals through content submitted to the Service
• Use the Service in a manner that violates any applicable law or third-party platform terms

We may suspend or terminate access for violations of these Terms at our discretion.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or secure. Content generated or displayed through the Service — including user-submitted and nominated cards — reflects the input of users and hosts, not the views of Trial by Chat.

7. Limitation of Liability

To the fullest extent permitted by law, Trial by Chat and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost streams, lost revenue, or reputational harm arising from content displayed during gameplay.

8. Third-Party Services

The Service relies on third-party providers, including Twitch (authentication and chat integration), Stripe (payment processing), and cloud hosting/infrastructure providers. Your use of those integrations is also subject to those providers' own terms and policies.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be noted with an updated "Last updated" date above.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service and cancel any subscription at any time.

11. Service Availability and Discontinuation

We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice. In the event the Service is permanently discontinued, we will make reasonable efforts to notify users in advance where practicable, but no refunds are guaranteed for one-time purchases beyond what is required by applicable law.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
